PRIVACY POLICY
This part sets out the PayMate policy withregard to the personal informationof a User of a GiftMate voucher, obtained by PayMate through its website or from details provided by the User. By accepting this Privacy Policy
and the Terms and Conditions, a User expressly consents to PayMate’s collection, storage, use and disclosure of this personal information as described herein.
Definitions
"User": shall mean and include (i) a person who registers himself on the PayMate
website to transact or avail of any PayMate service (ii) an applicant who registers
for GiftMate services and includes their heirs and assignees (iii) a purchaser/
recipient of a GiftMate voucher, (iv) an authorised merchant or dealer who sells
or resells GiftMate vouchers. "PayMate Associates" shall mean such entities that
provide joint services with PayMate, including banks and payment gateways.
User Information
When a User enters into a transaction with PayMate or avails of
a PayMate service, then it is likely that PayMate records shall contain any of the
following information about the User: - mobile phone number and PIN number; - e
mail address; - some financial information; - information provided by a User with
regard to shipping, billing or delivery of goods or services to the User, including
his address; - information from a User’s interaction with PayMate such as demographic,
geographic and navigation data, User’s interests, computer and connection information
and the like; - additional information sought by PayMate or PayMate Associates and
obtained from a User or third parties when conducting checks such as authenticity
checks and credit checks. By choosing to provide his personal information, a User
consents to the transfer and storage of that information on PayMate/ PayMate Associate
servers.
Use of User information
Such information is used to endeavour to improve PayMate services, in order to tailor
content to a User’s preferences and for the purpose of advertising. PayMate respects
the privacy of its Users and is committed to protect such privacy as detailed herein.
In addition, a User may encounter “cookies” or other similar devices on a web page.
These are data collection devices to help analyse our web flow and measure promotional
effectiveness. “Cookies” are small files placed on your hard drive that assist PayMate
in providing services to its Users and giving a User information targeted to his
interests. Most cookies are session cookies, meaning that they are automatically
deleted from a User’s hard drive at the end of a session. A User is always free
to decline a cookie if his browser permits. A User may also encounter a cookie
placed by a third party. PayMate does not control the use of such cookies placed
by third parties. When a User utilises the PayMate website or sends emails or other
data, information or communication to PayMate or any of its accredited merchants,
the User agrees and understands that such information and data may be communicated
through a third party payment gateway controlled by a PayMate Associate through
electronic records and a User consents to receive communications via electronic
records from such PayMate Associate periodically. Upon registration with PayMate,
a User agrees that he shall be contacted on his mobile or e mail address for authentication
of a transaction or from time to time about updating his content to provide features
which PayMate believes may benefit him or for the purpose of receiving promotional
messages. A User’s information shall remain with PayMate and PayMate Associates.
Further, a limited amount of this information will be available to an advertiser
who may use this information to send the User marketing communications.
Disclosure of Information
PayMate may also share a User’s personal information with any statutory or legal
authority as may be required or mandated by that authority. PayMate may disclose
personal information when required, such as to respond to legal requirements, enforce
PayMate policies or protect anyone's rights, property, or safety. Such information
will be disclosed in accordance with applicable laws and regulations. If required
by law to do so or if considered necessary to do so for proper management of credit
or business risk, PayMate reserves the right to disclose any and all User information,
including default in any payments or misuse of the service, to any court of competent
jurisdiction, quasi judicial authority, law enforcement agency, relevant wing of
the Central Government or State Government, User’s employer, credit reference agency,
financial institution or any company which is an affiliate or associate or parent
or subsidiary of PayMate. The content and advertisements on the PayMate website
are provided as part of the Paymate service. A User understands that advertising
plays an important role in the provision of this service and that PayMate may, from
time to time, send to users, promotional email/SMS about services offered by PayMate
and their advertisers. PayMate uses third-party advertisers to put up advertisements
on the PayMate website.These advertisers may use information (excluding name, address,
email address or telephone number) about a User’s visits to this and other websites
in order to provide information about goods and services which might interest him.
PayMate shall not sell or rent a User’s personal information to third parties for
their marketing purposes without his explicit consent. PayMate shall comply with
the DND regulations as framed form time to time.
Information security
The PayMate website includes links to other websites. Such websites are governed
by their respective privacy policies, which are beyond Paymate's control. Once a
User leaves the PayMate/ PayMate Associate servers, use of any information provided
by the User is governed by the privacy policy of the operator of the site which
the User is visiting. That policy may differ from this PayMate policy. All information
gathered on the PayMate website is securely stored and access to such information
is strictly limited based on need-to-know basis. In addition, details of a User’s
credit/ debit card number, PIN details for payment or for verification purposes,
password and account information are encrypted by PayMate. Further, PayMate does
not store the CVV number of a User. However, as effective as the security measures
are, no security system is impenetrable. The User is aware of all security risks,including
possible third party interception of any of his transactions and statements of account
on the internet and the content of his transactions or statements of account becoming
known to third parties. The User agrees and undertakes that he shall not hold PayMate/
PayMate Associates liable therefore in any way. The use and storage of any information,
including without limitation, the credit card number, PIN, password, account information,
transaction activity, account balances and any other information available on the
User’s internet access device or computer or mobile phone is at his own risk and
responsibility. The User furthermore acknowledges and accepts that PayMate may not
encrypt all content or communications from and to their website.
General
The User hereby agrees that the application and copies of all documents submitted
by a User are and shall remain the sole and exclusive property of PayMate, and PayMate
shall not be obliged to return the same to him upon his request. Any unauthorized
access to the PayMate web-site is a breach of these terms and a violation of the
law. A User agrees not to access PayMate web-sites by any means other than through
the interface that is provided by PayMate for use in accessing the same. Any content
that maybe restricted or banned by a government order, will be withdrawn during
the pendency of that order. PayMate is the sole and absolute owner of all and whatsoever
intellectual property rights in the trade mark “PayMate” and “GiftMate” and the
design in respect thereof will be entitled to take any legal action against any
person invading and/or encroaching upon the said rights.PayMate may amend this Privacy
Policy at any time by posting the amended terms on this site. If a User has any
